The Supreme Court of the nation has dismissed the appeal brought forth by Peter Obi, the presidential candidate of the Labour Party (LP) in the general election, challenging the victory of President Bola Tinubu.  Obi had alleged various issues, including Vice-President Kashim Shettima’s alleged double nomination, which he argued rendered Shettima unqualified to serve as Tinubu’s running mate. However, the Supreme Court ruled that the matter of double nomination had already been addressed in a prior judgment and could not be revisited.  The court stated, “This appeal lacks merit and is hereby dismissed.” The appeal by Obi consisted of seven issues, but the head of the seven-member panel of judges, Inyang Okoro, noted that issues 1, 2, 3, 5, 6, and 7 had already been addressed in a previous ruling related to Atiku Abubakar’s appeal.  Atiku Abubakar was the presidential candidate of the Peoples Democratic Party (PDP), and his appeal had also been dismissed by the court. As a result, the Supreme Court upheld the decision of the tribunal, affirming the election of President Bola Tinubu.

*Says Appeal Lacks Merit, Affirms Tinubu’s Victory  The Supreme Court, on Thursday dismissed the appeal by former Vice President and Presidential candidate of the Peoples Democratic Party, Alhaji Atiku Abubakar, seeking to nullify the February 25, presidential election of President Bola Tinubu. In the notice of appeal, Atiku had urged the apex court to dismiss and set aside the  September 6, judgement of the Presidential Election Petition Court, which affirmed the victory President Tinubu.  Determining the first issue for determination, held that failure to transmit election results electronically did not affect the outcome of the election and could not warrant the nullification of presidential election.  It held that Atiku did not produce alternative results of the presidential election that showed he won majority number of votes cast to rebuff the one declared by INEC. All the 7 issues distilled for determination were resolved in favour of Tinubu, stating that the appeal lacked merit.

In a Notice of Appeal predicated on 35 grounds, Atiku told the apex court that the tribunal in the judgment delivered by Justice Haruna Tsammani erred on the side of law and miscarriage of justice in its findings and conclusion in the petition. He maintained that the Tribunal erred in law when it failed to nullify the presidential election held on February 25, 2023, on the grounds of non-compliance with the Electoral Act, 2022, when by the evidence before the tribunal, INEC conducted the election based on grave and gross misrepresentation contrary to the principles of the Electoral Act 2022, based on the “doctrine of legitimate expectation”. Obi on his part, wants the Apex Court to set aside the whole findings and conclusions of the Tribunal on the grounds that they did not represent the true picture of the grounds of his petition. Reacting, counsel to the 1st, 2nd and 3rd Respondents respectively, urged the court to dismiss the appeal for want of merit and for being frivolous. Specifically, Tinubu’s lawyer, Wole Olanipekun SAN described Atiku’s appeal as abusive in nature and ask it to dismiss it. Tinubu urged the apex court to act in like manner of the Presidential Election Petition Tribunal (PEPT), by not only dismissing the appeal for lacking in merit and bona fide, but affirm his victory.

A former Secretary to the Government of the Federation (SGF), Dr David Babachir Lawal said in Abuja on Tuesday that the presidential candidate of the Labour Party, (LP) Peter Gregory Obi won the February 25 presidential election and not Bola Ahmed Tinubu as declared by the Independent National Electoral Commission (INEC). According to Babachir, available factual data as aggregated from several independent sources indicated that Obi got the majority votes while Atiku came second in the election, adding that Bola Tinubu came a distant third in the number of votes scored.  In a statement he issued on Tuesday, Babachir Lawal said “I have resisted the temptation to engage in the contemporary political discourse since the May, 2023 election faux pas. “I did this for two reasons; the first being that as an active player in the drama, I needed time to analyse and digest the data that led to the outcome(s) so I could arrive at an informed decision; the second, being that the rainy season had just set in and it was necessary that I focused my attention on my farms which are the mainstay of my livelihood.  “The current topical issues for political discourse and inquiry are whether or not Bola Tinubu won the presidential election and/or that he was apriori qualified to participate in the election given his murky bio data as is now being publicly unveiled daily in an avalanche.  “My answer to the first inquiry is that regardless of whatever INEC or Appeal Court said or did, Bola did not win the election.  “Right from the start of the campaigns, Bola new knew he was not going to win the election in a free and fair contest so he decided to go by all means.  “Available factual data as aggregated from several independent sources indicate that Obi got the majority votes while Atiku came second. Bola came a distant third in the number of votes scored.  “My answer to the second inquiry is that given the now unfolding deluge of uncomplimentary information about who or what he actually is, ordinarily, sound ethics and morality should have convinced him to voluntarily excuse himself from participation in the election.  “But this, notwithstanding, I believe he still has time and opportunity to save himself this public humiliation and embarrassment to his person, both locally and internationally by resigning so that he can give more attention to his health.  “After all, no one knows about the truism of these severely embarrassing and humiliating exposures about his person than the man himself.  “Leadership is all about integrity; sound pedigree, trustworthiness and the ability to unite and instil hope and confidence in the people one seeks to lead. In these qualities, most Nigerians are in total agreement that Bola has them in very very short supply indeed.  “But now, six months down the line, the chicken has come home to roost as Nigerians have come to the realization that we have not got what we deserved politically. “Confusion and despondency are now all over the nation as no one trusts the government to do what it says it will do. No one trusts the leader; and no one trusts appointees who are appointed as rewards for their roles in the election or who had in the past helped him in his life.  “Bola the President and his group are now in government and are in full control of Nigeria’s vast resources and opportunities. They are enjoying their offices while Nigerians languish in insecurity, poverty and hopelessness. “During the campaign, Bola mouthed some platitudes about competence; but we are so far yet to see it reflected in his political appointments. It seems more like he is rewarding people who supported him to get the Presidency at all cost. “This band of appointees that Bola is assembling into his government don’t care about Nigeria at all.  “Fuel prices will continue to gallop upwards until only they can afford it; the Naira will continue to race downhill in a free-fall until only they can afford anything in the market; insecurity will continue its escalation until every community in the nation is consumed by it”, he said.

The Omalegwuoku Progressive Initiative, an Igbo socio-political group, has criticized Peter Obi, the presidential candidate of the Labour Party (LP), for his recent comments about President Bola Ahmed Tinubu. The group called on Obi to refrain from making divisive remarks and challenging President Tinubu to reveal his personal details. During a news briefing in Abuja, Ambassador Ginika Tor, the Global President of the group and a Commissioner with the Federal Character Commission (FCC), expressed her disappointment. She argued that the President should focus on leading the country towards progress and development rather than engaging in discussions about his background. Tor stated, “It is an insult to Nigeria as a nation for you to call out our president… to say he is from this state, from this country, from this region, from this locality? Does he owe us that? What the President owes us now is to take us to our destination of choice.” She expressed her disappointment in Peter Obi, whom she had respected and referred to as her brother. In a report released by the British Broadcasting Corporation (BBC) on Wednesday, it has been revealed that there is no proof that President Bola Tinubu forged his academic record at Chicago State University (CSU). This revelation comes in the midst of controversy surrounding Tinubu’s academic credentials. Recently, Chicago State University had released and deposited Tinubu’s certificate to former Vice President Atiku Abubakar, as requested by a US court in the context of the 2023 Nigerian presidential election. While President Tinubu and his aides have consistently maintained the authenticity of his CSU certificate, Atiku’s camp had alleged that the certificate was falsified. However, the BBC’s Global Disinformation Team’s investigation has not found any conclusive evidence of forgery. The BBC report stated that they contacted CSU for clarification, and the university expressed confidence in the veracity and integrity of their records concerning Tinubu’s attendance and graduation. The report further highlights that there are three different versions of CSU certificates associated with Tinubu, including the original 1979 certificate, a second diploma submitted to the Independent Electoral Commission (INEC), and another replacement diploma from the early 2000s, which was never collected by Tinubu. Contrary to some allegations on social media, the BBC found that the phrase “with honours” does appear on Mr. Tinubu’s diploma from the early 2000s, which CSU authenticated during their investigation. CSU’s registrar, Caleb Westberg, affirmed that changes in the diploma template over the years might explain differences in appearance. He also attested to the authenticity of Tinubu’s diploma during his deposition. The BBC report concluded that CSU’s documents and Mr. Westberg’s statements confirm that President Tinubu graduated from CSU with honours, dispelling some of the doubts raised regarding his academic credentials.

This call comes in light of recent developments, where a US court ordered the release of President Tinubu’s academic records from the Chicago State University (CSU) at the request of the Peoples Democratic Party’s presidential candidate, Atiku Abubakar. During a press conference in Abuja, Obi requested that President Tinubu provide clarification regarding the schools he attended, whether he participated in the one-year National Youth Service Corps (NYSC) scheme, and if he ever changed his name. This, he believes, will help prevent what he described as an international embarrassment related to identity crisis. Former Anambra State Governor emphasized that having held the highest political office in the country, President Tinubu no longer has a right to personal privacy regarding his identity. It’s like building a non-gated house in a criminal-ridden society. You have to have a defence mechanism. Nobody floats what you don’t have a supply for. I believe that now that we have new CBN leadership, they have to look at the overall monetary policy. “It’s again not something you announce haphazardly. It’s something you look at critically. Nobody floats his currency without having an adequate supply. When you don’t have adequate supply, there will be pressure and criminality. We should have worked on eliminating those criminalities and excesses in our FX regime,” he said. The former Anambra State governor insisted that rather than float the naira, he would have devalued the naira. “What we would have done is devalue the currency to about 600 or thereabout while trying to manage what you have and encouraging exports. I can tell you that not even in the developed world has anybody left their currency to market forces because you might not be able to control it. After all, you cannot reverse your policy. “These are announcement defects that would have been well thought through by a proper economic team and consultation,” he added. It would be recalled that in June 2023, the Central Bank of Nigeria (CBN) unified exchange rate windows to maintain Naira stability against foreign currencies, notably the United States Dollar. The exchange rate in the investors’ and exporters’ window hit N810.78/$1 on Thursday, the highest rate for the day, and also fell to a low of N590/$1. However in the parallel market, bureau de change operators demanded an average rate of N1008 per dollar.
