Naira Abuse: Bobrisky appeals against sentence

Controversial cross-dresser Idris Okuneye, A.K.A Bobrisky has approached the Appeal Court, challenging the six months sentence given to him by a Federal High Court sitting in Lagos. He pleaded guilty before Justice A.O. Awogboro of the court on a four counts charge bordering on naira abuse proffered on him by Economic and Financial Crimes Commission (EFCC). However, the court on April 12 sentenced Okuneye to six months imprisonment without an option of fine to serve as a deterrent to others fond of abusing and mutilating the naira. Not satisfied with the verdict handed to him, Okuneye, through his counsel, Mr Bimbo Kusanu, has approached Court of Appeal, praying it to set aside the sentence. Specifically, Bobrisky is asking the court to replace the sentence with an option of N50,000 fine on each of the counts. In the notice of appeal, he submitted that the trial court imposed the maximum sentence on the appellant, who had no previous criminal record of conviction. He stated that there were options to impose a lesser sentence by the provisions of the Administration of Criminal Justice Act (ACJA). He averred that the sentence imposed by the trial court against the appellant was punitive and contrary to the mandatory provisions of the ACJA. The appellant stated that the trial court did not consider the positive antecedent of the appellant, who did not waste the time of the court by pleading guilty to the charge. He stated that the appellant honoured the invitation of the respondent on the first invitation. He said that the trial court failed to exercise its discretion judiciously and judicially in sentencing the appellant, explaining that such an act had occasioned a miscarriage of justice against his client.

Alleged N89.2b money laundering: Court to rule on service of charge on Yahaya Bello through lawyer

Justice Emeka Nwite will Tuesday, rule on the application whether the Economic and Financial Crimes Commission (EFCC) can serve court processes on former governor of Kogi state, Yahaya Bello, through his counsel. At the last adjourned date, EFCC’s counsel, Kemi Piniero SAN, urged the court to compel the ex-governor’s lawyer to accept service of the processes, explaining that it has been impossible to serve the charge sheet on him personally. Counsel to Yahaya, Abdul Wahab Mohammed, said he doesn’t have the authority of the defendant to accept service of the charges and proof of evidence. He insisted that the Abuja division of the court or the EFCC cannot arraign his client adding that his preliminary objection application has to be taken first, but the EFCC came behind him through a motion-exparte to obtain a warrant of arrest. Therefore, the court adjourned to reconvene Tuesday for ruling. The EFCC , Thursday, informed Justice Emeka Nwite about its intension to invite the Nigerian Army to effect the arrest of former governor of Kogi State, Yahaya Adoza Bello for arraignment before a Federal High Court sitting in Abuja. The anti-graft agency, through its legal team, issued the threat before the court after explaining how a person of immunity protected Bello from arrest following the court’s bench warrant. The court had fixed today(Thursday) for arraignment of Bello alongside the ex-governor’s nephew, Ali Bello, Dauda Suleiman and Abdulsalam Hudu on 19- count charges bordering on money laundering to the tune of N80, 246, 470, 088.88. When it was called up, Thursday, EFCC’s counsel, Kemi Piniero SAN, said in open court that the Commission was aware that Bello has been harboured in the home of a person that has immunity. He submitted that immunity is only attached to a person, not his house or car, adding that the law allows Nigerian security agencies to break into a house to arrest a defendant. He said, Some of the counts read: “That you, Yahaya Adoza Bello, Ali Bello, Dauda Suliman, and Abdulsalam Hudu( Still at large), sometime, in February, 2016, in Abuja within the jurisdiction of this Honourable Court, conspired amongst yourselves to convert the total sum of N80, 246,470, 088.88 (Eighty Billion, Two Hundred and Forty Six Million, Four Hundred and Seventy Thousand and Eight Nine Naira, Eighty Eight Kobo), which sum you reasonably ought to have known forms part of the proceeds of your unlawful activity to wit, criminal breach of trust and you thereby committed an offence contrary to Section 18(a) and punishable under Section 15(3) of the Money Laundering (Prohibition) Act, 2011 as amended”. “That you Yahaya Bello between 26th July 2021 to 6th April 2022 in Abuja within the jurisdiction of this Honourable Court aided E-Traders International Limited to conceal the aggregate sum of N3, 081, 804,654.00 (Three Billion, Eighty One Million Eight Hundred and Four Thousand Six Hundred and Fifty Four Naira) in account number 1451458080 domiciled in Access BankPlc, which sum you reasonably ought to have known forms part of proceeds of unlawful activity to wit, criminal breach of trust and you thereby committed an offence contrary to Section 18(a), 15(2) (d) of the Money Laundering (Prohibition) Act, 2011 as amended and punishable under Section 15 (3) of the same Act. “That you Yahaya Adoza Bello sometime in November 2021 in Abuja within the jurisdiction of this Honourable Court indirectly procured E-Traders international Limited to transfer the aggregate sum of $570,330.00 (Five Hundred and Seventy Thousand, Three Hundred and Thirty Dollars) to account number 4266644272 domiciled in TD Bank, United States of America which sum you reasonably ought to have known forms part of proceeds of unlawful activity to wit, criminal breach of trust and you thereby committed an offence contrary to Section 15(2) (d) of the Money Laundering (Prohibition) Act, 2011 as amended and punishable under Section 15( 3) of the same Act”. Bello’s arraignment followed a warrant of arrest and enrolment order granted the EFCC by Justice Emeka Nwite, Wednesday, in the motion ex-parte marked: FHC/ABJ/CR/98/2024 and filed by the EFCC lead counsel, Rotimi Oyedepo. The EFCC counsel argued that the ex-governor needs to be apprehended by security agencies so as to fast track his arraignment in court and immediate trial. The anti-graft agency maintained that the judge should either order Bello’s arrest or issue a public summons commanding the defendant to appear before the court.

Nigeria not ripe for state police, says IGP Egbetokun

The Nigeria Police Force has opposed the establishment of state police, saying the country was not ripe for such.  Speaking at a one day dialogue on state policing, Inspector General of Police (IGP), Kayode Egbetokun said the establishment of state police will execerbate ethnic tension, leading to divided loyalty in the states.  Represented by AIG Ben Okolo, the Inspector General of Police said the establishment of state police will also lead to multiple command structures in the states.  He also said that state governors are likely to abuse the privilege of state police by using it for political gains, leading to possible abuse of power and abuse of huma rights.  He argued that the state government lack thereof required funding that will give birth to the type of policing that the nation requires.  Rather than estabalisibg state police, he recommend the merging of the Nigeria Security and Civil Defence Corps and the Federal Road Safety Commission to form a department in the Nigeria Police Force.  He also said there is the need for a yearly recruitment of about 30,000 police personnel into the force annually to meet the UN requirements for morden policing, while also increasing annual budgetary allocation to the force.

Nigeria has resumed the prosecution of all Boko Haram detainees in Kainji The National Security Adviser (NSA), Nuhu Ribadu, disclosed this at the 2-day High-level African Counter-terrorism Summit in Abuja According to him, Nigeria is also gathering intelligence on the activities of Boko Haram and the Islamic State–West Africa Province (ISWAP), to tackle the groups headlong. The Under-Secretary-General for Counter-Terrorism, United Nations Office on Counter-Terrorism, Vladimir Voronkov, said the success of the United Nations lies in the collaboration of African countries towards providing African-based solutions.

Rainstorm Plunges 40 Ogun Communities Into Darkness

Forty communities in Ogun State have been plunged into darkness following a rainstorm on Sunday.  The downpour which began around midday, destroyed electricity facilities in some parts of the state, leading to a blackout. “Due to broken poles occasioned by the heavy downpour at Ota and Mowe, customers in the following communities: lyana lyesi, Osuke Town, Egan Road, lyana Ilogbo, Ijaba, Ijagba, Itele, Lafenwa, Singer, Joju, Alishiba, Oju Ore, Tollgate, Eledi, Akeja, Abebi, Osi Round About, Ota Town, Ota Industrial Estate, Igberen, lju, Atan, Onipanu, Obasanjo, Lusada, Arigba, Odugbe, Ado-Odo, Igbesa, Owode,” the Ibadan Electricity Distribution Company (IBEDC) said in a statement late Sunday. “Olokuta, Hanushi, Bamtish Camp Lufiwape, Eltees Farm, August Engineering, Spark Cear Soap Ayetoro, Amazing Grace Oil, Christopher University, Royal Garden Estate, Pentagon Estate, and environs are experiencing power outages”. It called on residents of the areas to avoid “contact with the broken poles, saggy wires or any other electrical installation affected by the rain”. “Our technical team is working to clear and replace the broken poles and installations to ensure power supply is restored as soon as possible,” IBEDC said.

INEC releases final list of candidates for Edo Governorship election

The Independent National Electoral Commission (INEC) has officially unveiled the final list of candidates for the forthcoming Edo State Governorship Election. Following the conclusion of initial primaries, the Commission had earlier disclosed the personal details of gubernatorial candidates and their running mates at its offices across the state. In compliance with the provisions of Section 33 of the Electoral Act 2022, certain political parties opted to conduct fresh primaries to replace their earlier nominated candidates before the 15th April, 2024 deadline. Notably, the Action Alliance (AA) and African Democratic Congress (ADC) made substitutions for their Governorship candidates and running mates. Additionally, the African Action Congress (AAC), All Progressives Grand Alliance (APGA), Boot Party (BP), and New Nigeria Peoples Party (NNPP) replaced only the running mates of their candidates. A total of seventeen (17) political parties will be fielding candidates in the election, with sixteen (16) being male and one (1) female. The final list, inclusive of detailed candidate information such as age, academic qualifications, and disability status, has been made accessible at INEC’s offices in Edo State, as well as on its website and social media platforms. Part of the statement signed by Sam Olumekun, National Commissioner & Chairman, Information and Voter Education Committee, read: ”With the publication of the final list of candidates for the Edo State Governorship Election, the next activity is the electioneering campaign. ”As provided by Section 94(1) of the Electoral Act 2022, campaigns by Political Parties in public shall commence not earlier than 150 days before polling day and end 24 hours prior to that day. ”Therefore, Political Parties are now permitted to start campaign in public from Wednesday, 24th April 2024 and end at midnight on Thursday, 19th September 2024, as indicated in items 8 and 12 of the Timetable and Schedule of Activities for the election. ”As parties commence this critical phase of the election, the Commission reminds candidates, agents and their supporters of the provision of the law and the Commission’s guidelines governing such activity. For emphasis, parties shall conduct their campaigns with civility and decorum devoid of inciting language, violence, voter inducement and other infractions mentioned in Sections 92 – 97 of the Electoral Act 2022.” The Edo State Governorship Election is scheduled to be held on Saturday, 21st September 2024.

Kenyan Police Arrest Binance Executive Who Escaped From Nigeria

The Kenya Police Service has successfully apprehended a senior executive of Binance, Nadeem Anjarwalla, who had been on the run, as efforts to extradite him to Nigeria gain momentum. This development was confirmed by government sources on Sunday night, who spoke to Punch under the condition of anonymity due to restrictions on their authority to discuss the matter publicly. One of the sources said, “Binance executive, Nadeem Anjarwalla, has been arrested by the Kenya Police Service, and he would be extradited to Nigeria this week by INTERPOL.” Another source noted, “As we had said before that Anjarwalla would be extradited, he has been arrested in Kenya, and he’ll be extradited to Nigeria this week.” Recall that the Federal Government revealed that it traced Anjarwalla to Kenya, following his escape from lawful custody in Nigeria. A source that spoke on the development at the time said, “We have found him. We know where he is; he is in Kenya, and we’re working with the authorities to bring him back to Nigeria. “All hands are on the deck, the government and all the security agencies are working hard in conjunction with the Kenyan authorities and INTERPOL, to ensure his return to Nigeria to face the charges brought against him.” Meanwhile, the EFCC Chairman, Ola Olukoyede, had in the March edition of its bulletin titled, “EFCC Alert,” confirmed that the commission was working in conjunction with the International Criminal Police Organisation, the United States’ Federal Bureau of Investigation, the governments of the United Kingdom, Northern Ireland, and Kenya to extradite Anjarwalla. Olukoyed said, “The takeover of the prosecution of Binance chiefs by the commission is no less a strong message in the direction of EFCC’s resolve to hedge in distortions and disruptions in the country’s forex market. “Tax evasion, currency speculation, and money laundering to the tune of $35,400,000 and are at the foundation of the Commission’s five counts against Binance Holdings Limited, Tigran Gambaryan and Nadeem Anjarwalla, the company’s chief executives. “While Gambaryan is currently in the Commission’s net, the process of extraditing the fleeing Anjarwalla is revving in full swing. Involved in partnership with the EFCC to nick Anjarwalla in flight are the International Criminal Police Organisation, the United States Federal Bureau of Investigation, the governments of the United Kingdom, Northern Ireland, and Kenya as the clock winds down to his arraignment in absentia alongside the company and Gambaryan.”

Senate gives update on P/Harcourt Refinery

The Senate Ad-Hoc Committee to Investigate the Turnaround Maintenance of Nigeria’s Refineries has said the Port Harcourt Refinery will begin operation before the end of December. This is as the Rivers State Governor, Siminalayi Fubara, has stated that his administration is working in tandem with President Bola Tinubu-led Federal Government’s policies designed to make life better for Nigerians through the Renewed Hope Agenda. Fubara noted that, in doing so, the Woji-Aleto-Alesa-Refinery Road, now 70 per cent completed, was being constructed to provide a bypass to easily access the Port Harcourt Refinery and take off traffic from the East-West Road. He made the remark when members of the Senate Ad-Hoc Committee to Investigate the Turnaround Maintenance of Nigeria’s Refineries, led by their Chairman, Senator Ifeanyi Ubah, paid him a courtesy visit at the Government House in Port Harcourt on Friday. This was contained in a statement issued in Port Harcourt on Saturday by the Chief Press Secretary to the Governor, Nelson Chukwudi. The governor said the purpose of governance was to make life easy for the people. He expressed delight that the Senate Committee’s investigation would make life easy and meaningful for Nigerians. The statement read, “We, as a state, before the commencement of the rehabilitation job, had a contribution that we wanted to make to support the work at the refinery because of the deplorable state of the East-West Road. “There is a road: Woji-Aleto-Alesa Refinery Road. We are almost completing the bridge. It’s about 70 per cent completed. We are doing almost the last part of it. With that road, it will help to decongest and reduce the trouble commuters face along the East-West Road while providing easy access, straight to the refinery. “So, you can see that our government is working in line, supporting the Administration of President Bola Tinubu to give our people hope and assurance that things will soon get better.” It added, “And it is this role that you are playing, genuinely. With the support of this state government, that is the only way we can achieve the purpose of governance for everyone. “The purpose of governance is to make life easy for the people. I am happy that your investigation would make life easy for the people,” the governor explained. Fubara pointed to the derivable benefits when the refinery is eventually revamped and becomes operational, both to the Federal Government and host, Rivers State. He added, “When the refinery restarts production, there will be petroleum products available locally. The issue of importation will go down. “We will now make an impact, the economy will grow, and internally generated revenue will increase. More projects will be executed in this state. You can see that it’s a chain effect thing. So, I want to thank you.”

FAAC Shares ₦1.1 Trillion Revenue To FG, States, LGs

The Federation Account Allocation Committee (FAAC) distributed a substantial sum of ₦1.123 trillion from the March 2024 Federation Account revenue to the federal, state, and local government tiers on Friday. The allocation, as reported by the Director of Press and Public Relations at the Office of the Accountant General of the Federation, Bawa Mokwa, reflects an uptick in several major revenue streams, including import duty, value-added tax (VAT), gas royalty, and companies’ income tax (CIT). According to a communique released after FAAC’s April meeting, the total distributable revenue consisted of ₦311.233 billion from distributable statutory revenue, ₦511.879 billion from distributable VAT revenue, ₦14.754 billion from Electronic Money Transfer Levy (EMTL), and ₦285.525 billion from exchange difference revenue. The total available revenue for March was ₦1,867,808,000,000. Deductions for the cost of collection amounted to ₦69.537 billion, while transfers, interventions, and refunds totaled ₦674.880 billion. March’s gross statutory revenue was ₦1.017 trillion, a decrease of ₦175.212 billion from February’s ₦1.192 trillion. Conversely, the gross revenue available from VAT for the same period was ₦549.698 billion, marking an increase of ₦89.210 billion over the previous month. The communique detailed that the Federal Government received ₦345.890 billion, state governments were allocated ₦398.689 billion, and local government councils received ₦288.688 billion. Additionally, mineral-producing states received ₦90.124 billion as a 13% derivation of mineral revenue. From the ₦311.233 billion distributable statutory revenue, the Federal Government received ₦133.960 billion, state governments ₦67.946 billion, and local government councils ₦52.384 billion. A total of ₦56.943 billion was distributed as derivation revenue to the benefiting states. For the distributable VAT revenue of ₦511.879 billion, the Federal Government received ₦76.782 billion, state governments ₦255.940 billion, and local government councils ₦179.158 billion. The allocation of the ₦14.754 billion EMTL revenue saw the Federal Government receiving N2.213 billion, state governments ₦7.377 billion, and local government councils ₦5.164 billion. Furthermore, from the ₦285.525 billion in exchange difference revenue, the Federal Government was allotted ₦132.935 billion, state governments ₦67.426 billion, and local government councils ₦51.983 billion, with an additional ₦33.181 billion shared as derivation revenue with the mineral-producing states.
